Peran Hukum Administrasi Negara dalam Mewujudkan Good Governance di Indonesia
ABSTRAK
Hukum Administrasi Negara (HAN) merupakan cabang hukum publik yang mengatur kewenangan pemerintah, hubungan antara pejabat administrasi negara dengan warga negara, serta mekanisme pengawasan terhadap tindakan pemerintahan. Dalam negara hukum, HAN berfungsi sebagai dasar legalitas agar setiap tindakan pemerintah dilakukan sesuai peraturan perundang-undangan dan tidak menyalahgunakan kewenangan. Keberadaan HAN memiliki hubungan erat dengan konsep good governance, yaitu tata kelola pemerintahan yang menjunjung prinsip transparansi, akuntabilitas, efektivitas, efisiensi, partisipasi, dan supremasi hukum. Penelitian ini bertujuan untuk menganalisis peran Hukum Administrasi Negara dalam mewujudkan good governance di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Data diperoleh melalui studi kepustakaan yang bersumber dari bahan hukum primer dan sekunder, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa HAN berperan penting dalam menciptakan pemerintahan yang baik melalui pengaturan kewenangan pejabat negara, pencegahan penyalahgunaan wewenang, peningkatan akuntabilitas, serta perlindungan hukum bagi masyarakat. HAN juga mendukung transparansi melalui keterbukaan informasi dan mendorong pelayanan publik yang profesional. Namun, implementasinya masih menghadapi hambatan seperti birokrasi yang belum efektif, rendahnya integritas aparatur, dan lemahnya pengawasan. Kesimpulan penelitian ini menegaskan bahwa Hukum Administrasi Negara merupakan instrumen penting dalam mewujudkan good governance di Indonesia. Oleh karena itu, diperlukan penguatan reformasi birokrasi, peningkatan kualitas aparatur, dan penegakan hukum yang konsisten agar pemerintahan yang bersih, efektif, dan terpercaya dapat terwujud.

ABSTRACT
State Administrative Law is a branch of public law that regulates governmental authority, the relationship between state administrative officials and citizens, as well as supervisory mechanisms over governmental actions. In a state governed by the rule of law, State Administrative Law functions as the legal foundation to ensure that every governmental action is carried out in accordance with statutory regulations and does not involve abuse of power. The existence of State Administrative Law is closely related to the concept of good governance, namely a system of governance that upholds the principles of transparency, accountability, effectiveness, efficiency, participation, and the rule of law. This study aims to analyze the role of State Administrative Law in realizing good governance in Indonesia. The research method employed is normative legal research using statutory and conceptual approaches. Data were obtained through library research derived from primary and secondary legal materials, which were then analyzed qualitatively. The results of the study indicate that State Administrative Law plays an important role in creating good governance through the regulation of the authority of state officials, the prevention of abuse of power, the enhancement of accountability, and the provision of legal protection for society. It also supports transparency through public access to information and encourages professional public service delivery. However, its implementation still faces obstacles such as ineffective bureaucracy, low integrity among public officials, and weak supervision. The conclusion of this study confirms that State Administrative Law is an essential instrument in realizing good governance in Indonesia. Therefore, it is necessary to strengthen bureaucratic reform, improve the quality of public officials, and enforce the law consistently in order to achieve a clean, effective, and trustworthy government.
